Apple has reached out to competitors and customers, requesting their feedback on the proposal to open its contactless payment technology in order to avoid potential fines within the EU. As a result, the European Commission (EC) has initiated consultations to determine whether Apple’s competition commitments are sufficient.

According to Apple’s proposal, the company would offer third parties access to its NFC-based payment system through a set of application programming interfaces (APIs), enabling developers to utilize the technology without relying on Apple’s payment services and wallet.

Earlier in 2022, the EC expressed a preliminary opinion that Apple is abusing its market position by limiting competition from other mobile wallets on iOS devices. An investigation into potential violations of antitrust laws is ongoing.

Apple is also proposing the establishment of an independent dispute resolution mechanism that would handle decisions regarding blocking access to NFC technology. Any decisions related to blocking access would be reported to the EC.

The EC has the authority to impose fines on Apple of up to 10% of its annual revenue if the company fails to meet its commitments, without having to prove any violation of antitrust laws.

The deadline for participation in the consultations has been set for February 19.
