US Appeals Court Temporarily Lifts Ban on Import of Apple Watch Series 9 and Ultra 2

The US Appeals Court has temporarily lifted the ban on the import of Apple Watch Series 9 and Ultra 2 based on the decision of the US International Trade Commission. This decision allows Apple to resume sales of the watches while the court considers whether the proposed changes to the devices resolve the patent issue.

Medical device manufacturers, such as Masimo, claim that the blood oxygen level measurement feature in Apple watches infringes their patents. However, Apple argues that it has developed industry-leading health, fitness, and safety features that provide users with confidence. The Appeals Court has granted Apple permission to continue selling the watches while awaiting the final resolution of the case.

As a result of this decision, Apple Watch Series 9 and Ultra 2 will once again be available in selected Apple retail stores in the US, with wider availability expected in the upcoming weekend. Unfortunately, the sales ban still applies to Apple’s online store, restricting customers’ purchasing options.

The US International Trade Commission now has until January 10th to respond to Apple’s request for a full suspension of the ban during the appeals process. During this time, the Appeals Court will evaluate the arguments from both sides and make a final decision.

While there are no guarantees that Apple will receive a full suspension of the ban and be able to sell the watches until the conclusion of the proceedings, this temporary break allows Apple to replenish stocks for external retailers. External stores, such as Best Buy and Walmart, are not subject to the ban and can continue to sell the watches, but they are unable to restock their inventory.

Apple remains hopeful that the court’s ruling will be favorable and enable them to continue offering customers innovative wearable technology.
