Suspension of Import and Sales of Apple Watches Temporarily Halted

In a recently concluded proceeding, the United States Court of Appeals has temporarily suspended the indefinite ban on the import and sales of Apple Watches. The ban, which went into effect on Tuesday, has been halted upon Apple’s request. The court has ordered the suspension until U.S. customs authorities evaluate the changes implemented by Apple, potentially aimed at avoiding the patent dispute that led to the ban. We expect a decision from these customs authorities on January 12th.

Thanks to this temporary suspension, Apple can temporarily resume the sales of Apple Watch Series 9 and Apple Watch Ultra 2. These watches were removed from Apple’s website last week and taken off store shelves this week due to the existing ban. Apple has not confirmed yet whether it plans to resume sales.

The initial ban was imposed due to a patent dispute with medical device manufacturer Masimo. The U.S. International Trade Commission determined that Apple infringed on Masimo’s patents, resulting in the sales ban. This means that other retailers can still sell their existing inventory of Apple Watches, but Apple itself cannot sell its watches or introduce new ones to the market.

As the appeals court considers a longer suspension of the ban, Apple has sought a temporary halt until a final verdict is reached regarding patent infringement. However, the court may need several weeks to make a decision.

The temporary suspension provides Apple with a momentary relief, but the outcome of a longer halt remains uncertain. Apple and its customers anxiously await the final judgment of the court as patent disputes continue.
